Interpretation
The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Account means a unique account created for You to access our Service or parts of our Service.

Application means the software program provided by the Company downloaded by You on any electronic device, named Refr Sports.

Country refers to: Colorado, United States.
Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.

Service refers to the Application.

It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.
Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

HOW TO OPT OUT
Option 1: Email Us To opt out, email us at support@refrsports.com with the subject line: “Opt Out Request” and include your name and contact information, and an indication that you would like to opt out of: sale, sharing/targeted advertising, or profiling.
Option 2: Use a Universal Opt-Out Signal. We honor the Global Privacy Control (GPC) and similar browser-based signals where required by law. If you have GPC enabled in your browser, your opt-out preferences will automatically be recognized.

THE TYPES OF DATA ACQUIRED ABOUT YOU
Personally Identifiable Information (PII)
“Personally Identifiable Information” alone or in combination with other information or in certain contexts can be used to identify, distinguish or trace you or the device(s) (collectively, “Device”) used to access the Site is referred to in this document as “PII”. PII, together with all other information about you and/or your Device(s) that we acquire is referred to collectively as your “personal data.” “Content” as used herein refers generally to any type of information, including text, images, video, whether sourced from you, us or third parties.

Sensitive PII
In certain circumstances, such as when purchasing a Product or Services, you may provide a credit, debit, or payment account number, or other payment information which we recognize as more sensitive than other PII. We generally do not request on or through the Site other Data that is often considered “highly sensitive,” such as other financial account information (e.g., credit report information, bank account numbers), personal health information (including gender, birthdate and age), or government issued identification numbers (e.g., social security number, drivers’ license number, or passport number). However, we will collect such Sensitive PII when necessary to offer you certain services or if you offer contractor services to, or apply for a job with us and/or receive an offer of employment.

Some of the personal data that we acquire cannot identify, distinguish or trace you or your Device, even if combined with other identifying information, and some Personal Data that could be considered PII when combined with other identifying information is not used in a way that identifies, distinguishes or traces you or your Device, but is instead used in an anonymous way, often aggregated with other anonymous Personal Data about other users.

In General
We collect only personal data that you provide to us voluntarily, and where applicable, with your consent. We take measures to ensure that we collect personal data for specified, explicit and legitimate reasons only — namely, to provide products and Services to you and meet our legal obligations. We also take steps to limit the personal data we collect to only the minimum necessary to carry out our business objectives.

Log Files
We may use log files to record data about each users’ visit to our Site. When you visit the Site, we may collect the IP (Internet Protocol) address connected to your computer (or the proxy server you use to access the World Wide Web), your computer operating system, the type of browser you are using, browser version, the pages of our Site or Services that you visit, the time and date of your visit, the time spent on those pages and other statistics, mobile device operating system (if you are accessing the Site using a mobile device), as well as the name of your ISP (Internet Service Provider) or your mobile carrier. We may use this information to analyze overall trends to help improve the Site. We do not share log data with third-parties, unless required by law to do so.
Telephone Consumer Protection Act
If you enter your telephone number into our Site or app or otherwise share it with us, you expressly agree to receive communications from us, our agents, representatives, affiliates, or business partners, via e-mail, SMS or text messages, phone calls, video calls, and push notifications. Data Acquired Elsewhere
We may also acquire your personal data offline or otherwise outside of the Site. COLLECTION AND USE OF DATA FROM INDIVIDUALS UNDER THE AGE OF 18
The Site and Services are primarily intended for users who are at least 13 years of age. Users who are ages 13 through 17 must have the permission of, and be directly supervised by, their parent or guardian to use the Site. Persons under the age of 13 may create an account and use the Site or Services only with express electronic consent of a parent or a guardian. This Privacy Notice governs data collection and use for users over the age of 13. If we become aware that we have collected Personal Information from a person under 13 years old without verification of parental consent, then we will take steps to remove that information from our servers. Data associated with users under 13 will be collected and used according to our COPPA Privacy Notice in addition to the terms in this Privacy Notice generally to the extent not inconsistent there with.
We constantly strive to align our data security practices with industry-accepted standards for securely handling, transmitting and storing personal data. To prevent unauthorized access, maintain data accuracy and the correct use of information, we implement administrative, physical and technical measures to safeguard and secure the information we collect on the Site.
